1. The agreement
These Terms of Use (the "Terms") are a legal agreement between you and Marpi FZC LLC, Sharjah, United Arab Emirates ("Qlozd", "we", "us"). They govern your use of the Qlozd mobile application, this website and the related services we provide (together, the "Service").
By installing or using the Service you agree to these Terms and to our Privacy Policy, which explains how we handle your data. If you don't agree, don't use the Service.
If you downloaded the app from Apple's App Store, section 10 also applies. If you downloaded it from Google Play, Google's terms of service and Google Play's policies also apply to the purchase.
2. Eligibility
You must be at least 16 years old to use Qlozd. By using the Service you confirm that you are. If you are under the age of legal majority where you live, your parent or guardian must agree to these Terms on your behalf and is responsible for your use of the Service.
3. Your account
Qlozd creates an anonymous account on your device the first time you open the app. You can optionally sign in with Apple or Google so your wardrobe is backed up and can be restored on another device. You are responsible for keeping your device and your sign-in credentials secure and for everything that happens under your account. Tell us promptly at rokasj+qlozd@gmail.com if you believe someone else has used your account.
You may use one account per person. We may require you to sign in before using certain features, for example to restore your wardrobe on a new device.
4. Licence
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the Qlozd app on devices you own or control, for your personal, non-commercial use, in accordance with the usage rules of the store you downloaded it from.
You may not, except where the law expressly permits it: copy, modify, translate or create derivative works of the Service; reverse engineer, decompile or attempt to extract its source code; rent, lease, sell, sublicense or otherwise transfer the Service or your access to it; remove or alter any proprietary notices; or use the Service in a way that circumvents the subscription or any other technical restriction.
5. Subscriptions and free trials
5.1 A paid service
Qlozd requires an active subscription. There is no free plan. New subscribers may be offered a free trial as described below.
5.2 Billing through the stores
Subscriptions are purchased through, and billed by, Apple's App Store or Google Play (each a "Store") to the payment method on your Store account. We don't process payments and don't hold your payment details. The Store's own terms also apply to your purchase.
5.3 Price
The price, currency, billing period and any free trial for each plan are displayed in the Store and in the app before you confirm the purchase. Prices vary by country and are set in your local currency through the Store's pricing tiers; the price that applies to you is always the one shown to you at purchase. By way of example only, the plans offered when these Terms were written were a yearly subscription at USD 59.99 with a 7-day free trial and a weekly subscription at USD 6.99 with a 3-day free trial, as displayed in the Store at purchase. Plans and prices may differ in your region and may change over time, as set out in section 5.8. Applicable taxes may be added by the Store.
5.4 Automatic renewal
Your subscription renews automatically at the end of each billing period, for the same period and at the then-current price, until you cancel it. Your Store account is charged for the next period within 24 hours before the current period ends. To avoid being charged, cancel at least 24 hours before the end of the current period.
5.5 Free trials
Where a free trial is offered, it begins when you confirm the purchase in the Store. You are not charged during the trial. Unless you cancel at least 24 hours before the trial ends, the trial converts to a paid subscription and the Store charges you for the first billing period. Free trials are available to new subscribers only, once per Store account; the Store determines eligibility. If you purchase a subscription before the end of a free trial, the Store may forfeit the unused portion of the trial. The length of the trial, the price that follows it and the date you'll be charged are shown in the app and in the Store before you confirm.
5.6 How to cancel
You cancel through the Store, not through us, and you can do so at any time:
- iPhone and iPad: open Settings, tap your name, tap Subscriptions, choose Qlozd and tap Cancel Subscription.
- Android: open the Google Play app, tap your profile picture, tap Payments & subscriptions, then Subscriptions, choose Qlozd and tap Cancel subscription.
Deleting the app, or deleting your Qlozd account, does not cancel your subscription. After you cancel you keep access until the end of the period you have already paid for. We don't provide refunds or credits for partial periods, except where the law requires it.
5.7 Refunds
Because your purchase is made from the Store, refunds are handled by Apple or Google under their own policies, and we cannot issue refunds for Store purchases ourselves. To request a refund, use Apple's "Report a Problem" page for App Store purchases, or Google Play's refund process for Google Play purchases. Nothing in these Terms limits any statutory right you may have as a consumer to a refund or to withdraw from a purchase.
5.8 Price changes
We may change the price of a subscription. If the price of your current subscription changes, the Store will notify you in advance and, where its rules require, ask you to agree to the new price before it applies. If you don't agree, cancel before your next renewal; otherwise the new price applies from the next billing period after the notice period.
5.9 Changes to plans
We may introduce, change or discontinue subscription plans. If we discontinue the plan you are on, we will give you reasonable notice and you will keep access until the end of your paid period.
5.10 Restoring purchases
If you reinstall the app or move to a new device, sign in to the same Store account and use You tab›Restore purchases in the app to reactivate your subscription. A subscription is tied to the Store account that bought it.
6. Acceptable use
You agree not to:
- use the Service for anything unlawful, or in a way that infringes anyone else's rights;
- upload content you don't have the right to use, or content that is abusive, sexually explicit, hateful or otherwise objectionable;
- interfere with or disrupt the Service, probe or test its security, or access it by automated means such as scripts, bots or scrapers;
- attempt to gain access to other users' accounts or data;
- use the AI features to generate content that is harmful, deceptive or unlawful, or attempt to extract the underlying prompts or models;
- circumvent the subscription, share one account between several people, or resell access to the Service.
7. Your content
You own the photos and information you add to Qlozd ("your content"). We don't claim ownership of it and we don't use it for marketing.
So that we can run the Service for you, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, modify (for example to create cutouts and thumbnails) and otherwise process your content solely to provide, operate, secure and improve the Service, including by sharing it with the service providers described in our Privacy Policy and, where you have consented, with our AI provider. This licence ends when you delete the content or your account, subject to the retention periods in the Privacy Policy.
You are responsible for your content and confirm that you have the rights needed to use it in Qlozd. We may remove content that breaks these Terms.
We recommend exporting your data from time to time using You tab›Export my data.
8. AI features
Qlozd can use artificial intelligence (currently Claude, by Anthropic) to suggest names, categories and tags for your items, and to assemble outfits and packing lists from your wardrobe. AI features are optional and run only after you consent in the app; you can withdraw that consent at any time.
AI output is generated automatically. It may be inaccurate, incomplete, repetitive or unsuitable for you, and it may describe your items incorrectly. It is a suggestion to help you decide, not professional advice of any kind, including styling, fashion, weather, travel or financial advice. Cost-per-wear and similar figures are estimates based on what you enter. Review suggestions before relying on them; your decisions are your own.
We may change, replace or discontinue the models and providers behind AI features at any time.
9. Third-party services
The Service relies on third parties, including Apple and Google (distribution, payments, sign-in), RevenueCat (subscription management), Supabase (hosting and storage), Anthropic (AI, with your consent) and Expo (app updates). Their terms apply to your use of their services, and we are not responsible for third-party services we don't control. Where the app links to third-party websites or services, we don't endorse them and aren't responsible for them.
10. Additional terms for apps downloaded from the Apple App Store
If you downloaded Qlozd from Apple's App Store, the following also applies. These Terms are between you and Marpi FZC LLC only, not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content. The licence in section 4 is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Apple has no obligation to furnish any maintenance or support services for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, claims under consumer protection or similar legislation, and claims that the app infringes a third party's intellectual property rights, including their investigation, defence, settlement and discharge.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms of agreement when using the app. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of them, have the right to enforce these Terms against you.
11. Availability and changes
We work to keep Qlozd available but don't guarantee that it will be uninterrupted or error-free. We may change, suspend or discontinue any feature at any time, including AI features and the models behind them, and we may release updates that change how the app works. Some updates may be required to keep using the Service. If we discontinue the Service entirely, we will give you reasonable notice and an opportunity to export your data.
12. Intellectual property
The Service, including the Qlozd name and logo, the app, this website, and all software, designs and text in them (but not your content), is owned by Marpi FZC LLC or its licensors and protected by intellectual property laws. Apart from the licence in section 4, no rights are granted to you. If you send us ideas or feedback, you agree we may use them without any obligation to you.
13. Termination
You may stop using Qlozd at any time and delete your account from inside the app (You tab›Account›Delete my account). Remember to cancel your subscription in the Store as well; deleting your account doesn't cancel it.
We may suspend or terminate your access to the Service if you materially breach these Terms, if we are required to by law, or if we discontinue the Service. Where practicable we will give you notice and a chance to put things right. If we terminate for your breach, you are not entitled to a refund except where the law requires it.
Sections that by their nature should survive termination (including sections 7, 8, 12, 14, 15, 16, 17 and 19) will survive.
14. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that cutouts will be accurate, that AI suggestions will be correct or suitable, that the Service will meet your requirements, or that data will never be lost. We take care to protect your data and recommend that you export it periodically.
If you are a consumer, nothing in these Terms affects the statutory rights that cannot be excluded or limited under the law of the country where you live.
15. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or in connection with the Service or these Terms, however caused and under any theory of liability.
To the fullest extent permitted by law, our total liability to you for all claims arising out of or in connection with the Service or these Terms will not exceed the amount you paid for the Service in the twelve months before the event giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any other liability that cannot be excluded or limited by law.
16. Your responsibility to us
To the extent permitted by law, you agree to compensate us for losses, costs and reasonable legal fees we incur as a result of your content, your breach of these Terms, or your unlawful use of the Service. This does not apply to the extent the loss is caused by our own breach or negligence.
17. Governing law and disputes
These Terms are governed by the laws of the laws of the Emirate of Sharjah and the federal laws of the United Arab Emirates, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country.
If you have a problem, please contact us first at rokasj+qlozd@gmail.com; most issues can be resolved quickly and informally. If you live in the European Union, you may also use the European Commission's online dispute resolution platform.
18. Changes to these Terms
We may update these Terms from time to time. We'll post the new version on this page with a new effective date and, for material changes, tell you in the app before they take effect. If you don't agree to the updated Terms, stop using the Service and cancel your subscription before the changes take effect. Continuing to use the Service after that date means you accept the updated Terms.
19. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor of our business, and we'll tell you if we do. Apart from Apple under section 10, no one else has rights under these Terms. These Terms are written in English; if we provide a translation, the English version prevails to the extent the law allows.
